Intervertebral Disc Syndrome (IVDS)

Intervertebral Disc Syndrome can be rated based on incapacitating episodes instead of range of motion if that produces a higher rating. Incapacitating episodes require prescribed bed rest by a physician within a 12-month period. IVDS includes conditions commonly known as bulging disc, degenerative disc disease, herniated disc, pinched nerve, prolapsed disc, ruptured disc, and slipped disc. The ROM rating and the incapacitating episode rating cannot be combined; the veteran receives whichever is higher. If rated under the incapacitating episodes schedule, separate ratings for related spine nerve conditions are not allowed.

VA Rating Levels

10%

At least 1 week but less than 2 weeks of incapacitating episodes in a 12-month period.

20%

At least 2 weeks but less than 4 weeks of incapacitating episodes in a 12-month period.

40%

At least 4 weeks but less than 6 weeks of incapacitating episodes in a 12-month period.

60%

More than 6 weeks of incapacitating episodes in a 12-month period.

Exam Tips & Key Evidence

  • For incapacitating episodes to count, the bed rest has to be prescribed by a physician. Resting on your own at home doesn't meet the criteria.
  • You'll receive whichever rating is higher between the range-of-motion schedule and the incapacitating episodes schedule. They can't be combined.
  • If your rating ends up being based on incapacitating episodes, you won't be able to get separate ratings for radiculopathy under the same claim.
  • Keep in mind that DDD is not classified as arthritis, so it doesn't qualify for presumptive service connection.
