Peripheral Neuropathy (Diabetes-Related)

Peripheral neuropathy, particularly when secondary to diabetes (Agent Orange presumptive), is rated under 38 CFR § 4.124a based on the specific nerve affected and severity. Each extremity is rated separately.

VA Rating Levels

10%

Mild incomplete paralysis. Occasional numbness or tingling. You can generally function normally but notice symptoms regularly.

20%

Moderate incomplete paralysis. More persistent numbness, weakness, or pain. Difficulty with fine motor tasks (hands) or balance issues (feet).

40%

Severe incomplete paralysis. Significant loss of sensation, muscle weakness, or pain. Difficulty walking (feet) or gripping (hands).

60%

Complete paralysis of the affected nerve group. Total loss of function in the affected area.

Exam Tips & Key Evidence

  • If you have Type II Diabetes (especially Agent Orange presumptive), peripheral neuropathy in all four extremities is commonly secondary — that's four separate ratings
  • Request EMG/nerve conduction studies to document severity
  • Each hand and each foot is rated individually — make sure every limb is evaluated
  • Early-onset neuropathy from Agent Orange exposure has special presumptive rules
