Stroke and cerebrovascular accidents are rated under 38 CFR § 4.124a, Diagnostic Code 8007. The acute event is rated 100% for 6 months, then re-evaluated based on residual neurological deficits.

VA Rating Levels

100%

During acute/active phase and for 6 months following the stroke.

60%

Significant residuals — marked motor or cognitive deficits; hemiplegia with marked assistance needed for daily activities.

40%

Moderate residuals — some motor weakness, speech, or cognitive problems that limit function.

20%

Mild residuals — slight motor or sensory deficits, generally manageable.

Exam Tips & Key Evidence

  • After the 6-month acute period, file for specific residuals: weakness, speech problems, cognitive impairment, bowel/bladder dysfunction
  • Stroke is commonly secondary to hypertension, IHD, or AFib
  • TIA (transient ischemic attack) with residuals is also ratable
